Poker in the United Kingdom: the law, the live rooms and the calendar

The United Kingdom is one of the few countries where both halves of poker are settled: online play is licensed and supervised by the Gambling Commission, and live poker runs openly in casinos and dedicated card clubs from Aberdeen to Plymouth. For a British player the practical questions are not whether they may play, but which site holds the right licence, what checks they face before the first hand, and whether HMRC has an interest in the result. Who licenses online poker here

Online gambling offered to players in Great Britain is regulated by the Gambling Commission, and the conditions attached to an operator's licence are what give a British player their protections. The practical test is simple: check that the room you are about to deposit with holds a Gambling Commission licence for British customers, rather than assuming that a familiar brand name carries one. Large operators run several separate entities on separate domains, and only some of them are licensed for this market.

Age and identity: checked before the first hand, not at cash-out

The Commission's player guidance is unambiguous. All online gambling businesses must ask you to prove your age and identity before you gamble, and a customer cannot place a bet until they have been verified. Checks are often instant where a business can match an account electronically; otherwise a passport, driving licence or household bill may be requested.

The more useful half of the rule is the one players rarely know. A gambling business cannot require proof of age and identity as a condition of withdrawing money if it could have asked earlier, and the Commission states that delaying a withdrawal for insufficient ID may breach Licence Condition 17 and attract regulatory action. Anti-money-laundering requests can still arise later, but they should come promptly rather than at the moment a player tries to take money out.

The age limit, as the Act writes it

Under section 47 of the Gambling Act 2005 it is an offence to invite or permit a child or young person to enter premises while a casino premises licence is being relied on. In the Act's vocabulary a child is under 16 and a young person is 16 or 17, so the practical effect is that nobody under 18 may be in a casino while it is operating as one.

How HMRC treats a winning player

HMRC's Business Income Manual is explicit that skill and system do not create a trade. At BIM22017 the guidance states that the fact a taxpayer has a system for placing bets, or is successful enough to earn a living by gambling, does not make the activity a trade, and it quotes the judgment in Graham v Green on precisely the poker case: a skilful card player who plays every day and wins more often than the people he plays against is not thereby carrying on a vocation. The manual's own summary is that expertise or being systematic is not enough.

There is a boundary, and it is worth knowing. The same guidance notes that some professional gamblers do carry on a trade, for example where they receive appearance money for a television programme, because that is a service supplied to a customer for reward. Whether winnings then form part of that trade depends on the facts.

This is general information rather than tax advice. A player whose income is mostly sponsorship, streaming, coaching or appearance fees rather than winnings has a question worth putting to an accountant.
