YaPoker in Chile: no regulator in the terms, none in Chile either, and a 10% rake rule bef

Chile is the clean case for a page like this, because both sides of the question come back empty. Chile has no online gambling licence for a poker room to hold, and YaPoker's own end-user licence agreement — which we read in full from the operator's page on 14 October 2026 — names no gaming regulator, no licence number and no restricted or permitted countries.

What the agreement does contain is a condition on getting money out, and it is the reason this page exists in the form it does: clause 6.1.2 requires cumulative poker rake equal to at least ten per cent of your cumulative deposits before a withdrawal is authorised.

This is general information, not legal advice.

The clause to read before you deposit

Clause 6.1 of the agreement is headed PRIMARY PRODUCT MANDATE AND MANDATORY POKER RAKE REQUIREMENT.

Clause 6.1.2 states that to be eligible to request a withdrawal of any funds — and it names initial deposit balances, sportsbook winnings, casino payouts and horse racing returns — all account holders, regardless of their primary gaming preference, must generate cumulative poker rake, or paid tournament entry fees, equal to at least ten per cent of the total value of their cumulative deposits before withdrawal authorisation will be granted.

Clause 6.1.3 closes the loophole: sportsbook, casino and racebook wagering does not count toward the requirement, reduce it or substitute for it, whatever the volume, because those wagers generate no poker rake. Clause 6.1.4 states that accounts used exclusively or predominantly for sports betting, casino games or horse racing will have withdrawal requests withheld until the requirement is satisfied, and reserves the network's right to close accounts that attempt to meet it through collusion, chip-dumping or artificial rake generation.

That is a real constraint, disclosed in the terms. A Chilean player with no local regulator standing behind the account should know it before the first deposit rather than at the first cash-out.

Chile's own position: casinos yes, online nothing

Our Chile page sets this out in full. The Superintendencia de Casinos de Juego licenses and supervises land-based casinos under the 2005 casino law, and Chile has a substantial licensed casino industry as a result.

Online gambling is the gap. Chile has debated an online licensing bill more than once without enacting one, so there is no Chilean licence for an online poker room to hold and no domestic regulator supervising online play. Nothing in Chilean law makes it an offence for an individual to play poker online; the legal questions have concerned operators and payment processing.

The consequence is the one to carry: no Chilean licence means no Chilean consumer protection. No local regulator to complain to, no domestic dispute resolution, no locally enforced self-exclusion. The operator's own licence and record are all that stands behind a balance — which makes what the agreement says about that licence the important part of this page.

What the agreement says about the licence, which is very little

The document states that the games are owned and operated by "Ya Poker", that the licence granted to you to play them is governed under the laws of Curacao, and that a sublicence is granted thereunder to International Processing Services S.A. Payment processing for deposits and cash-outs is governed by the laws applicable to Yatahay, Limited as the payments services provider.

That is the whole of it. There is no named gaming authority, no licence number, no company registration number and no registered address anywhere in the agreement — we searched for each of them. "Governed under the laws of Curacao" is a choice of law, not a regulator, and the two are often confused on pages like this one.

Clause 6.1.1 does answer one useful question: YaPoker is part of the Winning Poker Network, and the clause names the network's rooms as Ya Poker, ACR Poker, Black Chip Poker, Americas Cardroom and TruePoker. A shared pool is the reason a room like this reaches a market with no domestic online liquidity at all.

No country list, in either direction

We looked for a restricted-territory clause, a prohibited-country list and for Chile by name. None is present, and the only jurisdiction named in the document is Curacao.

What the agreement does instead is place the obligation on the player: you are prohibited from using the website or the software if you are under 18, if you are below the legal age of majority in your jurisdiction, or if you are connecting from a jurisdiction from which such use is prohibited or from which it would be illegal for the operator to offer the software. Clause 3.2 adds that no licence is granted to any user located in a jurisdiction where the offer or the use would violate applicable law.

For Chile that resolves fairly cleanly, since nothing in Chilean law makes individual play an offence — but it resolves on Chilean law, not on anything the operator has said.

If something goes wrong

The agreement's dispute provision is short and favours the house: any controversy or dispute between players, or between a player and the poker room, is to be settled by the poker room, whose decision is stated to be final and binding in all respects, and disputes must be reported by email. There is no external regulator, ombudsman or alternative dispute resolution body named, and there is no Chilean body to approach either.

Two smaller clauses: chat is restricted to English or Spanish, so Spanish is supported at the tables; and commercial or professional use of the software as part of a business of betting or wagering is strictly forbidden — the licence is personal use only, worth knowing for anyone treating the game as more than recreation.

Check withdrawal routes before depositing meaningfully. Peso handling and the local payment rails vary more between rooms than the lobbies suggest, and the 10% rake condition sits on top of whatever the payment route adds.

What this page will not print

No bonus amounts, no rake-race prize pools, no leaderboard figures. Promotional terms are varied at the operator's discretion and a number verified weeks ago can be wrong today. Read the current offer on the operator's own promotions page on the day you sign up, and read clause 6.1.2 with it.

Frequently asked questions

Is online poker legal in Chile?

There is no Chilean online gambling licence and no agency supervising online play — the Superintendencia de Casinos de Juego regulates land-based casinos only. Nothing in Chilean law makes it an offence for an individual to play; the legal questions have concerned operators and payment processing. General information, not legal advice.

Does YaPoker restrict Chilean players?

Its terms do not say. We read the end-user licence agreement in full on 14 October 2026: there is no restricted-territory clause and no prohibited-country list, Chile is not mentioned, and the only jurisdiction named anywhere in it is Curacao. The agreement instead prohibits use by anyone connecting from a jurisdiction where such use is prohibited, leaving the judgement to the player.

What is the 10% rake requirement?

Clause 6.1.2 states that to be eligible to request a withdrawal of any funds — including initial deposit balances, sportsbook winnings, casino payouts or horse racing returns — an account holder must generate cumulative poker rake or paid tournament entry fees equal to at least ten per cent of the total value of their cumulative deposits before withdrawal authorisation is granted. Clause 6.1.3 states that sportsbook, casino and racebook wagering does not count toward it.

Who licenses YaPoker?

The agreement names no gaming regulator and no licence number. It states that the licence to play the games is governed under the laws of Curacao, with a sublicence granted to International Processing Services S.A., and that payment processing is governed by the laws applicable to Yatahay, Limited. A choice of law is not the same as a regulator.

Which network does YaPoker belong to?

The Winning Poker Network. Clause 6.1.1 names its rooms as Ya Poker, ACR Poker, Black Chip Poker, Americas Cardroom and TruePoker, and describes the network as operating primarily as a peer-to-peer poker platform.

Where would a dispute be heard?

By the poker room itself, under the agreement: any controversy or dispute between players, or between a player and the poker room, is settled by the poker room, whose decision is final and binding in all respects, with disputes reported by email. No external body is named, and Chile has no online gambling regulator to approach.

What is the minimum age?

18 under the agreement, or the legal age of majority in your own jurisdiction if higher; the under-age clause states that age information is verified before any funds or prizes are paid out. The minimum gambling age at Chilean casinos is also 18.
